Overview

These Terms of Service (“Terms”) govern your use of the Kitchen Admin website and your purchase and use of Kitchen Admin products.

Kitchen Admin is operated by LIFE AND RECIPE LTD, a company registered in England and Wales (“Kitchen Admin”, “we”, “us” or “our”). Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.

By accessing our website or purchasing a product from us, you agree to these Terms together with our Privacy Policy and Return and Refund Policy. If you do not agree to these Terms, you should not use our website or purchase our products.

1. Our products

Kitchen Admin provides digital products and operational tools designed primarily for use within professional kitchen environments.

No physical product will be shipped unless expressly stated otherwise on a product page.

We make reasonable efforts to describe and demonstrate our products accurately. Product images, demonstrations and example data are provided to illustrate the product and its functionality. Appearance may vary slightly depending on the software, device, operating system or software version used.

You are responsible for reviewing the product description, included files and any stated compatibility requirements before purchasing.

We may update, modify or discontinue products from time to time. Any such changes will not affect your statutory rights in relation to products you have already purchased.

2. Orders and payment

When you place an order, you are offering to purchase the selected product at the price displayed.

An order is accepted when we confirm your purchase following successful payment processing.

You are responsible for providing accurate and complete information when placing an order, including a valid email address to which digital products and order information can be delivered.

Prices are displayed in the currency shown on the website and include or exclude applicable taxes as stated during checkout.

We may refuse or cancel an order where reasonably necessary, including where payment cannot be authorised, there is an obvious pricing or product-description error, fraud or unauthorised activity is suspected, or we are legally required to do so.

If we cancel an order after payment has been taken and no digital content has been supplied, the relevant payment will be refunded.

3. Digital delivery and cancellation

Kitchen Admin products are supplied electronically.

Where digital content is made available immediately after purchase, you will be asked to agree to immediate access and acknowledge the effect this has on your cancellation rights.

Once supply of the digital content has begun following the required consent and acknowledgement, the statutory 14-day cancellation right will no longer apply.

This does not affect your statutory rights where digital content is faulty, not as described or otherwise does not conform to the contract.

4. Licence and permitted use

When you purchase a Kitchen Admin digital product, you receive a licence to use that product in accordance with these Terms. Ownership of the intellectual property in the product is not transferred to you.

You may use purchased Kitchen Admin products:

• for your own professional or business use;

• as part of your work within a kitchen or hospitality operation; and

• with members of the kitchen or operational team for whom you are using the product, where reasonably necessary for its intended purpose.

You may make reasonable working copies of the files where necessary for permitted use.

Unless we give you prior written permission, you must not:

• resell, redistribute, sublicense or commercially reproduce a Kitchen Admin product;

• upload or make the original product files publicly available;

• share the product with another business, organisation or person for their independent use;

• sell or distribute modified versions of the product;

• represent a Kitchen Admin product or substantial part of it as your own product; or

• use our products to create competing templates, systems or digital products for sale or distribution.

5. Intellectual property

The Kitchen Admin website, branding, product designs, digital files, written materials, graphics, images, videos and other original content are owned by or licensed to LIFE AND RECIPE LTD and are protected by applicable intellectual property laws.

Kitchen Admin and associated branding may not be used in a way that suggests endorsement, affiliation or ownership without our prior written permission.

Nothing in these Terms transfers ownership of our intellectual property to you except for the limited right to use purchased products as expressly described in these Terms.

6. Product use and responsibility

Kitchen Admin products are designed to support kitchen organisation and administration. They are tools intended to assist users with operational processes and do not replace professional judgement, management responsibility or appropriate checks and procedures within your kitchen or organisation.

You remain responsible for the information you enter into the products, how you use that information, and operational decisions made using the products.

Where a product contains calculations, formulas, dropdowns or other automated functionality, you should review outputs as appropriate for your circumstances.

Nothing in this section excludes or restricts any rights or remedies that cannot lawfully be excluded.

7. Problems with digital products

If you experience difficulty accessing your purchase, receive an incorrect file, or believe that digital content is faulty or not as described, please contact us at lifeandrecipes@proton.me with your order number and details of the issue.

Where required by applicable consumer law, we will provide the appropriate remedy.

Nothing in these Terms limits your statutory rights.

8. Third-party software and compatibility

Kitchen Admin products may be designed for use with third-party software or platforms, such as spreadsheet applications.

Any compatibility requirements known to us will be stated in the relevant product information where appropriate.

Third-party platforms and software are operated independently of Kitchen Admin. We are not responsible for changes made by third-party providers to their software, services or availability, except to the extent that applicable law requires otherwise.

Your use of third-party software may also be subject to the provider's own terms and policies.

9. Shopify

Our store is powered by Shopify, which provides the ecommerce platform through which we offer our products.

Purchases from Kitchen Admin are transactions between you and Kitchen Admin. Shopify provides the underlying ecommerce technology and is not the seller of Kitchen Admin products.

Certain personal information associated with your use of the store may be processed by Shopify as described in our Privacy Policy and Shopify's applicable privacy documentation.

If you purchase Kitchen Admin products wholly or mainly for business purposes, different legal rights may apply to your purchase.

Because our store is hosted by Shopify, Shopify also processes certain information associated with your access to and use of the store.

Changes will not retrospectively remove rights you have in relation to purchases already made.

If you are a consumer, you will retain any mandatory protections and rights available to you under the laws applicable to you, and nothing in these Terms is intended to restrict any rights regarding where you may bring legal proceedings that cannot lawfully be restricted.
